TOURISM VICTORIA WIN A CREATIVE DATE IN MELBOURNE

Be as creative as you like; entries will be individually judged on literary and creative merit.
All entries must be received by 5:00pm AEST on 25/06/09

1. Information on how to enter and the Prize available forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Incomplete, indecipherable or illegible entries will be deemed invalid.
5. Entries are limited to one per person and each entry must be submitted in accordance with these terms and conditions.
6. Promotion commences on 15/05/09 and closes at 5.00pm on 25/06/09; all entries must be received by 5:00pm AEST on 25/06/09. The winner will be notified by telephone and email by 5.00pm on the 30/06/09. This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit of t he answer provided to the question. The Promoter’s decision is final and no correspondence will be entered into.
7. The best entry, as determined by the Promoter in its absolute discretion, will win a weekend to Melbourne including; a return flight from Sydney to Melbourne, travel insurance one night at Grand Hyatt, airport transfers within Melbourne, dinner and drinks on Saturday night the 04/07/09, tickets to see the Jersey Boys at the Princess Theatre in Melbourne , tickets to the Jersey Boys after party, tickets to the Melbourne Museum to see Pompeii the exhibition, the latest Blackberry (model TBC), Elk Accessories and Alpha 60 clothing Hair and make-up on the night by a professional stylist; prize values combined will be to the value of no more than AU$5,000. The prize does not include airport transfers within Sydney, meals other than those previously listed, additional spending money, additional transfers, items of a personal nature, in-room charges or other ancillary costs.
8. The winner must be available to travel on Saturday the 4th of July 2009 AEST from Sydney to Melbourne and return to Sydney from Melbourne on Sunday the 5th of July 2009 otherwise a different entrant will be selected in replacement. The tickets are non-transferable and fight times will be confirmed at a later date.
9. Frequent flyer points will not form part of the prize. The winner may be required to present its credit card at time of accommodation check in.
10. The Prize is subject to the standard terms and conditions of individual prize and service providers.
11. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the Prize has been booked, take the Prize or an element of the Prize at the time stipulated, then the Prize or that element of the Prize will be forfeited and will not be redeemable for cash.
12. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize of equal value and/or specification.
13. The maximum value of the Prize is AU$5,000. The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash.
14. All entries submitted become the property of the Promoter. No entry will be returned to any entrant. As a condition of entering into this promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel this promotion.
16. Any cost associated with accessing the Website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) if Jersey Boys musical is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of the Prize.
18. The Promoter collects personal information from entrants in this promotion in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the personal information provided by entrants for promotional, marketing and publicity purposes including sending electronic messages or telephoning an entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
